Flatmate.ng is a website owned, operated, and maintained by Boldswitch Softwares Ltd.
This platform serves as an online community facilitating two main user groups:
People with available accommodations seeking tenants or co-tenants can:
Create a Listing for their rental properties by uploading relevant Content.
Search Listings for individuals looking to rent accommodation as tenants or cotenants.
People seeking to rent accommodation can:
Create Listings for themselves by uploading Content.
Search for available rental properties and connect with those offering
accommodations for rent.
By accessing, registering on, or using the Website, or utilizing its Services, you agree
to adhere to the Terms and Conditions of Use outlined herein.
Flatmate.ng reserves the right to modify, amend, or revise these Terms and
Conditions of Use (including any Services offered) at its sole discretion, and you are
bound by such changes. While Flatmate.ng will attempt to notify users of major
changes, it is your responsibility to periodically review the most current version of
these Terms and Conditions of Use.
In these Terms and Conditions of Use:
▪ “Content” encompasses graphics, photos, text, videos, and location data related to
available accommodations or users seeking accommodations
▪ “Intellectual Property Rights” refer to copyright, patents, trademarks, designs, and
other statutory rights, as well as common law or equitable rights safeguarding
business or personal reputation.
▪ “Listing” denotes an online advertisement or promotion either offering rental
properties or seeking available accommodations to rent.
▪ “Personal Information” holds the meaning defined in the Privacy Act.
LISTINGS
1.1 Users Uploading Listings
If you upload Content and/or create a Listing:
You must ensure that the Content and Listings are accurate, not duplicated, and kept
up-to-date when uploaded and during their availability on the Website.
Remove any Content and Listings promptly when:
▪ The accommodation in the Listing is no longer available for rent or the vacancy is
filled, whichever occurs first.
▪ The user seeking accommodation in the Listing has secured housing or no longer
requires it, for any reason, whichever occurs first.
▪ You are solely responsible for evaluating any user contacting you regarding a
Listing and their suitability for the vacancy or the accommodation’s suitability.
Flatmate.ng will not provide information about such users or assist in assessments,
such as background checks.
▪ Ensure that any proposed rental agreement complies with Local, State, or federal
laws concerning rental accommodation, including residential tenancy law and
others.
▪ If you use the Services in a manner violating these Terms and Conditions of Use
or if we deem any Content or Listing unacceptable, Flatmate.ng may take
appropriate action, such as modifying or deleting Content or Listings, adjusting
access to your Account, terminating your Account, or taking any other suitable
action at its discretion. Inactive Content or Listings may also be removed by
Flatmate.ng if deemed necessary.
▪ Flatmate.ng has the discretion to delete, deactivate, or edit any Content or
Listings that are duplicated, breach our Terms and Conditions, or are deemed
inappropriate.
▪ Flatmate.ng does not make representations or warranties regarding any Website
user, including their suitability, behavior, or creditworthiness as a tenant or
prospective tenant for any listed accommodation.
▪ Flatmate.ng does not conduct any vetting, questioning, or identity checks on
individuals who create Listings offering accommodations or those who upload
Content for such Listings. Additionally, Flatmate.ng does not verify the accuracy,
completeness, or truthfulness of any Content or location details provided in
Listings, including location data obtained through Google’s Google Maps service,
either directly or through third parties.
ACCOUNTS
2.1 Registration
To upload Content, you must register with Flatmate.ng and provide certain
information, including your name, email address, and mobile telephone number, to
create an Account. After creating an Account, you must enter an activation code sent
to your mobile telephone number by Flatmate.ng. By registering an Account, you
represent and warrant that you are the account holder for the provided mobile
telephone number.
You must meet the following criteria:
▪ Be 18 years old or older, or of the age of majority in your jurisdiction when
accessing the Website.
▪ If you are under 18 years old or under the age of majority in your jurisdiction,
you must have the permission or consent of one of your parents or legal guardians
to register an Account and upload Content to the Website. Additionally, at the
time of registration, you must represent and warrant that you meet the age
requirements or have the necessary permission or consent.
▪ You further represent and warrant that the information you provide to
Flatmate.ng for opening an Account is accurate and true. If any of this
information becomes inaccurate during your Account’s term, you must promptly
update Flatmate.ng.
Any personal information you share with Flatmate.ng will be handled in accordance
with Flatmate.ng’s Privacy Policy, available at https://www.Flatmate.ng/privacy.
▪ You are prohibited from using another user’s Account without Flatmate.ng’s
express prior written permission. You are solely responsible for all activities that
occur on your Account. You must maintain the security of your Account details,
including your password and verification information, and promptly inform
Flatmate.ng of any security breaches or unauthorized access to your Account.
2.2 Request Account Deletion
You have the option to delete your Account at any time and for any reason by visiting
your account settings and locating the “Delete Account” option at the bottom of the
page. Deleting your account will result in the removal of your personal information
and active listings from the website.
If you wish to temporarily pause your listings while keeping your account, you can
deactivate your account from your dashboard. After deactivation, you can log back
into your account at any time.
2.3 Termination
Flatmate.ng reserves the right, at its absolute discretion, to suspend or terminate your
Account if:
▪ You violate any term or condition outlined in these Terms and Conditions of Use.
▪ Flatmate.ng believes, in its sole judgment, that your continued use of the Service
might harm Flatmate.ng’s reputation or result in Flatmate.ng breaching applicable
laws.
WEBSITE AND SERVICES
3.1 Use of Website and Services
When using the Website and Services, you must not:
▪ Use them for purposes other than renting or seeking accommodation.
▪ Cause damage or interruptions to the Website’s functionality.
▪ Engage in activities that infringe on Intellectual Property Rights.
▪ Attempt to uncover source code or copy software.
▪ Compromise the Website’s security.
▪ Introduce viruses or engage in unauthorized access.
▪ Violate laws or engage in improper or unlawful activities.
▪ Promote or engage in services of a sexual nature.
▪ Post offensive or harmful content.
▪ Threaten or harm others.
▪ Infringe on the Intellectual Property Rights of others.
▪ Send unsolicited advertising.
▪ Collect personal information without consent.
▪ Disrupt the Website or Services or harm other users.
▪ Impersonate others or use false information.

When you upload Content on the Website, you agree to abide by these Terms and
Conditions of Use. Flatmate.ng doesn’t review or approve Content; it’s your
responsibility to ensure it complies with these terms.
4.2 Rights to the Content
When uploading Content, you confirm that you have the right to do so, including
necessary permissions from individuals depicted in the Content. Your Content must
not infringe on others’ rights or be offensive or illegal.
4.3 No endorsement
Flatmate.ng doesn’t endorse Content or Listings posted by users.
4.4 Ownership
You retain ownership of your Content, and Flatmate.ng has no rights to it except as
granted under these terms.
4.5 Licence
By uploading Content, you grant Flatmate.ng a broad license to use and display it on
the Website and associated sites.
4.6 Take-down or modification of Content or Listing
Flatmate.ng may edit or remove Content or Listings if they violate these terms.
4.7 Release
You release Flatmate.ng from claims related to its use of your Content.
4.8 Waiver
You waive moral rights regarding your Content as outlined in these terms.
4.9 Access to and use of Messages, other Content, and correspondence by
Flatmate.ng
Flatmate.ng may access and store messages and Content for safety and security
purposes.
4.10 Collecting reviews
Flatmate.ng may request reviews based on your experiences. Reviews must be
genuine and follow guidelines. Flatmate.ng may publish and disclose reviews as
described in these terms.
TENANCY
Flatmate.ng is not involved in user agreements or disputes related to accommodation
rental.
INTELLECTUAL PROPERTY RIGHTS IN WEBSITE
You can use Website Content as permitted by these terms, but you cannot use it in
ways that violate these terms or infringe on Flatmate.ng’s rights.
